1. Agreement to Terms

By downloading, installing, or using the Ember mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. Ember is operated by HEXELITY LABS S.R.L. ("we", "us", or "our").

2. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the App. By using Ember, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Description of Service

Ember is an AI-powered entertainment application that generates humorous "roasts" based on text, photos, or screenshots you provide. The App uses artificial intelligence to produce comedic content and is intended solely for entertainment purposes.

4. Account & Authentication

Ember uses anonymous authentication — an account is automatically created on your first launch without requiring an email or password. Your account is tied to your device. You are responsible for maintaining the security of your device and your access to the App. We are not liable for any loss or damage arising from your failure to secure your device.

5. Free & Premium Plans

5.1 Free Tier

The free tier grants you up to 5 roast generations per day with the Friendly tone. Daily limits reset every 24 hours.

5.2 Premium Subscription

Premium unlocks unlimited roast generations, all tones, and additional features. Premium subscriptions are billed through Apple In-App Purchases and managed via your Apple ID account.

5.3 Billing & Renewal

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel subscriptions in your device's Settings > Apple ID > Subscriptions.

5.4 Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple's support channels in accordance with Apple's refund policy. We do not process refunds directly.

6. User Content & Input

6.1 Your Content

You retain ownership of the text, photos, and screenshots you submit to the App ("User Content"). By submitting User Content, you grant us a limited, non-exclusive license to process it solely for the purpose of generating roasts and providing the service.

6.2 Generated Content

AI-generated roast outputs ("Generated Content") are provided to you for personal, non-commercial use. You may share Generated Content freely, but you acknowledge that similar or identical outputs may be generated for other users given similar inputs.

6.3 Content Responsibility

You are solely responsible for the content you submit and how you use Generated Content. Do not submit content that you do not have the right to use, or content that infringes on others' intellectual property, privacy, or rights.

7. Acceptable Use

You agree NOT to use the App to:

• Harass, bully, threaten, or intimidate any individual
• Generate content intended to defame or harm real individuals
• Submit illegal, obscene, or exploitative content, especially involving minors
• Circumvent rate limits, quotas, or security measures
• Reverse-engineer, decompile, or tamper with the App or its APIs
• Use automated tools, bots, or scripts to access the service
• Resell, redistribute, or commercially exploit the service or its outputs
• Impersonate any person or entity, or misrepresent your affiliation

We reserve the right to suspend or terminate access for any user who violates these rules, without prior notice.

9. Intellectual Property

The App, including its design, code, branding, logos, and UI, is the intellectual property of HEXELITY LABS S.R.L. and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to our data practices as described in the Privacy Policy.

11. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not guarantee any specific results from using the App. Your use of the App is at your sole risk.

12. Limitation of Liability

To the maximum extent permitted by applicable law, HEXELITY LABS S.R.L. and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the App, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless HEXELITY LABS S.R.L. and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your User Content, your use or sharing of Generated Content, or your violation of these Terms.

14. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and governing law) shall survive.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HEXELITY LABS S.R.L. operates, without regard to conflict of law principles. Any disputes arising from these Terms or the use of the App shall be resolved through binding arbitration, except where prohibited by law, in which case you may bring claims in a court of competent jurisdiction.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. We will update the "Last updated" date at the top of this page when changes are made. Your continued use of the App after any modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HEXELITY LABS S.R.L. regarding the use of the App and supersede any prior agreements or understandings.
